Terms of Use
These terms are the agreement between you and Lumira Labs Ltd, a company registered in England and Wales (company number 17138788), the company that makes Yaply. By using the app you agree to them. Apple's standard Licensed Application End User Licence Agreement also applies to your use of the app. Our Privacy Policy explains what happens to your data.
Who can use Yaply
You need to be 18 or over and to sign in with your Apple Account. One account per person, please, and keep your phone locked so nobody else answers as you.
Your answers are yours
You own what you write, record and draw in Yaply. So that we can deliver it, you give us permission to store it, copy it between our servers and the devices of the people you've chosen, and show it to them. That permission is only for running Yaply, and it ends when you delete the content or your account, except for anything we have to keep because of a report or the law. The people you play with can see what you send them, and we can't stop someone taking a screenshot, so send things you're comfortable sharing with that person.
How to play fair
Yaply is for people who know each other. Don't use it to harass, threaten, bully or frighten anyone, and don't send sexual content to someone who hasn't chosen to receive it. Don't share anything involving a child in a sexual way, anything illegal, other people's private information, or recordings of people who didn't agree to be recorded. Don't pretend to be someone else, send spam, try to get into other people's accounts, or interfere with how the app or our servers work. The adults-only decks are explicit. Only switch them on for yourself, and only play them in a room or a party game when everyone there is an adult and has agreed.
You can block anyone and report any answer, note or person from inside the app. We review reports and aim to act within 24 hours. We may remove content or suspend or close an account that breaks these terms, and where it involves a risk to someone's safety we may contact the police.
Yaply Plus
Some decks are free. Yaply Plus opens every deck and is an auto-renewing subscription, sold monthly or yearly through the App Store. The price and length are shown on the screen before you buy and confirmed by Apple. The yearly plan may come with a free trial if your Apple Account is eligible. When it ends, you're charged for a year unless you cancel at least 24 hours before.
Payment is taken by your Apple Account when you confirm. Your subscription renews automatically at the same price and for the same length unless you turn off auto-renew at least 24 hours before the end of the current period, and your account is charged within the 24 hours before it renews. You can manage or cancel it at any time in your iPhone's Settings, under your name, then Subscriptions. Cancelling stops the next renewal and you keep Plus until the period you've paid for ends. Refunds are handled by Apple under its own policies, at reportaproblem.apple.com. If you've turned on Family Sharing, people in your family group can use Plus too. If you reinstall the app or change phones, use Restore Purchases.
Things that can change
We'll keep improving Yaply, which means features, decks and games can change or be removed. If we ever raise the price of Plus, Apple will tell you first and ask you to agree before you're charged the new price. We may update these terms. If a change matters, we'll tell you in the app before it applies, and if you keep using Yaply after that it means you accept the new terms.
Not medical advice
Yaply is a game. Nothing in it is medical, psychological or relationship advice, and it isn't a replacement for talking to a professional. If you or someone else is in danger, contact your local emergency number.
Our responsibility
We work hard to keep Yaply running and your answers safe, but the app is provided as it is and we can't promise it will always be available or free of errors. Back up anything you'd hate to lose with Download Everything in Settings. We're not responsible for what other people send you, though we will act on reports. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't let us limit, and none of it affects your statutory rights as a consumer. Apart from that, we're not liable for losses that weren't foreseeable, and our total liability to you is limited to what you've paid for Yaply Plus in the 12 months before the problem.
Ending things
You can stop at any time and delete your account with Delete Everything in Settings. Remember that deleting the app doesn't cancel Plus, so cancel that in your iPhone's Settings too. We can suspend or close an account that seriously or repeatedly breaks these terms.
Apple
These terms are between you and Lumira Labs Ltd, not Apple. Apple isn't responsible for Yaply or its content, has no obligation to provide support for it, and isn't responsible for any claims about it. Apple and its subsidiaries can enforce these terms as third-party beneficiaries.
The law
These terms are governed by the law of England and Wales. If you live elsewhere in the UK or in the EU, you keep the protection of your local consumer law and can bring a claim in your own courts. If something goes wrong, please email us first at yaply@lumiralabs.co.uk. Most things can be sorted out that way.
